CAPCOM COMPETITION ("COMPETITION")
TERMS AND CONDITIONS ("TERMS AND CONDITIONS")
1. This Competition commences at 12:01 (GMT) on 18th June 2007 and closes at 12:00 (GMT) on 14th July 2007 ("the Competition Period"). The Promoter will not accept any entries that are received before the start or after the end of the Competition Period.
2. By entering this Competition, you will be deemed to have read, understood and accepted these Terms and Conditions. These Terms and Conditions will be deemed to include the entry instructions detailed on the CAPCOM website.
3. This Competition is open to UK residents excluding employees and families of CE Europe Limited, the Promoter, its agencies, or anyone professionally associated with the Competition.
Anybody scoring over ‘1000’ will be entered into a draw to win one of five lost planet tee-shirts. Anybody scoring over ‘2000’ will be entered into a draw to win one of four sets of the game and a lost planet tee-shirt. Anybody scoring over ‘3000’ will be entered into a prize draw to win a figurine, a copy of the game and a lost planet tee-shirt.
4. You may enter the Competition as many times, and as often, as you wish but you may only win 1 Prize per person.
5. No cash alternatives will be offered for any Prizes. All Prizes are non-transferable. The Promoter reserves the right in its sole discretion to substitute any and all Prizes with prizes of comparable value.
6. Any Prizes that are unclaimed after 21 days from the date of notification will be deemed to have been forfeited and the Promoter reserves the right to offer an unclaimed Prize to the competitor who achieved and uploaded the next highest score in respect of the Competition.
7. Successful winners will be required to take part in certain publicity and other promotional activities as required by the Promoter. By entering into the Competition, you hereby agree that the Promoter shall have the right to use your name and likeness for advertising, promotional, marketing and publicity purposes without any additional compensation.
8. Only winners will be contacted personally to arrange delivery of prizes.
9. The receipt by you of any Prize is conditional upon you complying with any and all applicable laws, rules and regulations including, without limitation, these Terms and Conditions.
10. The Promoter shall not be liable for any liability, claims, demands, penalties, expenses and causes of action for personal injury and/or death and/or damage and/or theft and/or loss suffered in connection with the Competition or for the use, possession or acceptance of any of the Prizes awarded pursuant to the Competition save for personal injury or death where the same is caused by the Promoter's negligence.
11. Winners' names and counties will be made available upon receipt of a written request to CE Europe 1 month after the closing date of the competition.
12. Winners will be notified by either e-mail, phone or SMS within 30 days of the Competition Period ending.
13. The Promoter accepts no responsibility for incorrect, illegible, misdirected, corrupted, damaged, incomplete or otherwise invalid entries or entries made fraudulently or dishonestly. The Promoter will not be responsible for high scores that are not uploaded or otherwise not received, or registered, or recognised, or delayed. The Promoter will not be liable for a person being unable to register a high score due to system failures, network error, viruses, bugs, glitches, site being down, hacks on the system, handset problems or for any other reason whatsoever.
14. The Promoter does not guarantee continuous, uninterrupted or secure access to the Capcom site, game application or site. Numerous factors outside of the control of the Promoter and/or Operator may interfere with the operation of the portal, game application or site.
15. The Promoter will not be liable for any claims or losses due to differing game performances between different keyboards.
16. Any person suspected of cheating in the opinion of the Promoter through the manipulation of high scores or otherwise fraudulently or dishonestly falsifying data, 'hacking' into data servers or acting in any way fraudulent or dishonest in the opinion of the Promoter will be disqualified from the Competition. Without limiting any other remedies, the Promoter may suspend or terminate your account if the Promoter suspects that you have engaged or are about to engage in, or have been in any way associated with or involved in, fraudulent or dishonest activity in connection with the site.
17. The Promoter reserves the right to suspend or terminate the account of any person who it suspects has violated or infringed any of these Terms and Conditions.
18. The decision of the Promoter in relation to this Competition will be final and binding and no correspondence will be entered into.
19. The Promoter and the Operator (as appropriate) will retain and use your details for the purpose of administrating the Competition.
20. The Promoter shall be entitled to modify the Competition (including, but not limited to, varying the Competition Period) or these Terms and Conditions at any time during the Competition Period by publishing any such modification on the CAPCOM site.
21. If any part of these Terms and Conditions are found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable then such part will be severed from the remainder of these Terms and Conditions, which will continue to be valid and enforceable to the fullest extent permitted by law.
22. These Terms and Conditions shall be governed by and construed in accordance with UK law and subject to the exclusive jurisdiction of the UK courts.
